These Terms and Conditions ("Terms") govern your access to and use of the website at www.regencypalmssenior.com and every related page, community page, landing page, form and digital property operated by Regency Palms Senior Living ("Regency Palms," "we," "us," or "our"), together referred to as the "Website."
By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use the Website.
Regency Palms Senior Living operates licensed assisted living and memory care communities in California, with corporate offices at 2020 Main Street, Suite 300, Irvine, CA 92614.

These Terms also apply automatically to any additional community that Regency Palms Senior Living opens, acquires, manages or operates in the future, and to any new website, landing page, form or digital property we launch for those communities, without the need for separate terms. References in these Terms to "our communities" should be read to include all current and future Regency Palms Senior Living communities.
These Terms govern use of the Website only. They do not govern residency, care services or any commercial relationship with a community. Those matters are governed exclusively by the written Residency Agreement, admission agreement and related documents signed with the relevant community.
The Website is intended for adults aged eighteen and over who are located in the United States. By using the Website, you represent that you are at least eighteen years old and that you have the legal capacity to accept these Terms.
You may view, browse and print pages of the Website for your own personal, non-commercial use in connection with evaluating senior living options. Any other use requires our prior written permission.
When using the Website, you agree that you will not:

All content on the Website, including descriptions of care levels, amenities, programmes, activities, floor plans, dining, technology and services, is provided for general informational and marketing purposes only.
Nothing on the Website is medical, nursing, clinical, legal, financial, tax, insurance or professional advice, and nothing on the Website should be relied upon as a substitute for such advice. Use of the Website does not create a physician-patient, provider-patient, caregiver, fiduciary or professional relationship of any kind between you and Regency Palms Senior Living or any of its staff.

Submitting an inquiry, requesting information, scheduling a tour, or completing a form on the Website does not create any obligation on either party, does not reserve an apartment or a care placement, and does not guarantee admission to any community.
Admission to any Regency Palms Senior Living community is subject to a formal assessment of care needs, availability at the relevant community, applicable licensing rules and admission criteria, and the execution of a written Residency Agreement. Any statement on the Website regarding care outcomes, wellbeing, comfort or quality of life is a general description of our approach and is not a promise, warranty or guarantee of any particular result for any individual.
Pricing, fees, care levels, apartment types, availability, amenities, programmes, staffing, technology and services described on the Website are subject to change at any time without notice, and may vary by community, by apartment and by assessed level of care. Rates shown on the Website, if any, are starting rates or estimates only and do not include care charges, community fees, second-person fees or other charges. Current pricing is confirmed in writing by the relevant community.
Photographs, renderings, floor plans and videos are illustrative. They may show model apartments, staged settings, stock imagery or previous configurations and may not depict a specific available apartment or a current resident.
We make reasonable efforts to keep the Website accurate and current, but we do not warrant that any content is complete, accurate, current or free of error, and we may correct, change or remove content at any time without notice.
Our communities are licensed as Residential Care Facilities for the Elderly by the California Department of Social Services, Community Care Licensing Division. Each community holds its own licence, and the licence number is displayed on the relevant community page of the Website and at the community itself. Services offered at each community are limited to those permitted under its licence. Services and licence status may differ between communities.
The Website provides contact and inquiry forms, telephone numbers and email addresses so that you can reach us. Information submitted through these channels is handled in accordance with our Privacy Policy.
By submitting a form or providing your contact details, you agree that Regency Palms Senior Living and the community you inquired about may contact you at the telephone number, email address and postal address you provided, by call, voicemail, email and, where you have opted in, SMS or text message, in order to respond to your inquiry and to provide information about our communities. Calls may be placed manually or with automated technology. Consent to receive marketing calls or texts is not a condition of any tour, service, residency or purchase. Message and data rates may apply. You may reply STOP to opt out of text messages, or use the unsubscribe link in any marketing email.
Calls to and from our communities may be monitored or recorded for quality assurance and training purposes.
Please do not submit medical records, diagnoses, medication lists, insurance identification numbers, Social Security numbers, financial account numbers or other sensitive information through the Website or by unencrypted email. The Website is not a secure channel for sensitive information and is not a patient portal. Communications submitted through the Website are not confidential or privileged.
The Website does not offer user registration, resident accounts, online payment or e-commerce functionality. We will never ask you to submit payment card details, bank account details or a deposit through a Website form. "Regency Palms," "Regency Palms Senior Living," the Regency Palms logo, and the names of our communities are marks of Regency Palms Senior Living. Third-party names, logos and technologies referenced on the Website, including any monitoring, health or hospitality technology used at our communities, are the property of their respective owners and are referenced for identification purposes only.
Except as expressly permitted in Section 3, you may not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works from, publicly display, frame, or use for any commercial purpose any part of the Website without our prior written permission. All rights not expressly granted are reserved.
If you believe that content on the Website infringes your copyright, please contact us at the address in Section 19 with details sufficient to identify the work and the allegedly infringing material, and we will investigate.
If you submit a review, testimonial, comment, photograph, suggestion or other content to us through the Website, by email, or through our social media pages, you grant Regency Palms Senior Living a non-exclusive, royalty-free, worldwide, perpetual, transferable licence to use, reproduce, edit for length and clarity, publish and display that content in connection with our communities and our marketing, in any medium, without further notice or compensation. You represent that you own or have the right to grant this licence and that the content does not infringe the rights of any person.
Testimonials reflect the individual experience of the person who gave them and are not a guarantee that any other person will have the same experience.
Photographs and video taken at community events may include residents, family members, staff and visitors. Images of residents are used only where a valid written consent or authorisation is on file. If you appear in an image on the Website and wish it removed, contact us and we will remove it promptly.
The Website may contain links to third-party websites, applications and services, including senior living directories and referral services, review platforms, social media, mapping and navigation services, healthcare and hospice providers, and advertising and analytics platforms. You agree to indemnify, defend and hold harmless Regency Palms Senior Living, its affiliates, communities and their respective owners, officers, directors, employees and agents from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or relating to your use of the Website, your violation of these Terms, your violation of any applicable law, or your infringement of the rights of any third party.
These Terms and any dispute arising out of or relating to them or to the Website are governed by the laws of the State of California, without regard to its conflict of law principles.
Before filing any claim, you agree to first contact us using the details in Section 19 and to attempt in good faith to resolve the matter informally for a period of at least thirty days. Most concerns can be resolved this way.
If the matter is not resolved informally, you and Regency Palms Senior Living agree that the exclusive venue for any action arising out of or relating to these Terms or the Website shall be the state or federal courts located in Orange County, California, and each party consents to the personal jurisdiction of those courts. Nothing in this Section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property rights, and nothing in this Section applies to a dispute arising under a signed Residency Agreement, which is governed by the dispute resolution terms of that agreement.
