Regency Palms Senior Living ("Regency Palms," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect through our website at www.regencypalmssenior.com and our related pages, forms, phone lines and digital advertising, how we use that information, who we share it with, and the choices and rights available to you.

Please read this Policy carefully. By using our website or submitting information to us, you acknowledge that you have read and understood this Privacy Policy.

2. Scope of This Policy

This Policy applies to www.regencypalmssenior.com, to every community-specific page, landing page, form and microsite we operate, and to the information we collect by telephone, email, text message and online advertising in connection with those properties.

It applies to all assisted living and memory care communities operated under the Regency Palms Senior Living name, which currently include:

This Policy also applies automatically to any additional community that Regency Palms Senior Living opens, acquires, manages or operates in the future, and to any new website, landing page or digital property we launch for those communities, without the need for a separate policy. References in this Policy to "our communities" should be read to include all current and future Regency Palms Senior Living communities.

This Policy does not apply to the separate privacy practices of third-party websites you may reach through links on our site, or to the handling of protected health information of current residents, which is addressed in Section 9 below.

3. Information We Collect

3.1 Information You Provide Directly

We collect information that you choose to give us, for example when you submit a contact or inquiry form, request a tour, request pricing or a brochure, sign up for updates, call or text one of our numbers, email us, or apply for a position. Depending on what you submit, this may include:

• Your name and the name of the prospective resident
• Email address, telephone number and mailing address
• Your relationship to the prospective resident, for example spouse, adult child or power of attorney
• Preferred community, desired move-in timeframe, and budget or payment source
• General care needs and lifestyle preferences that you voluntarily describe in a message or during a call, such as level of assistance required, mobility, memory support needs or dietary preferences
• Any other information you choose to include in a free-text message field or voicemail
• For job applicants, resume and employment history information

Providing this information is voluntary. If you choose not to provide it, we may not be able to answer your inquiry or arrange a tour.

3.2 Information Collected Automatically

When you visit our website, certain information is collected automatically by us and by our technology partners, including:

• IP address and the general location derived from it, such as city, region and country
• Device type, operating system, browser type and screen settings
• Pages viewed, time spent on each page, links clicked, scroll depth, and the referring website or advertisement
• Date and time of your visit and general interaction data
• Identifiers stored in cookies and similar technologies, as described in Section 6

3.3 Information From Third Parties

We may receive information about you from sources such as:

• Senior living referral and placement services and directory websites, where you have submitted an inquiry to them
• Advertising and analytics platforms, including Google, Microsoft and Meta, which provide aggregated and campaign performance data
• Family members or legal representatives who contact us on a prospective resident's behalf
• Healthcare providers, discharge planners, social workers or case managers, where they contact us with your knowledge in connection with a placement
• Publicly available sources

4. How We Use Your Information

We use the information described above for the following purposes:

• To respond to your inquiry, answer questions, provide pricing and availability, and schedule and confirm tours
• To follow up with you by phone, email or text message about your inquiry and about the community you expressed interest in
• To assess whether our communities can meet the care needs described, and to guide you to the most appropriate community
• To send you newsletters, event invitations, community updates and other marketing communications where you have asked to receive them or where permitted by law
• To operate, maintain, secure, troubleshoot and improve our website and online forms
• To measure and improve the performance of our advertising, understand which campaigns generate inquiries, and reduce wasted advertising spend
• To personalise the content and advertising you see, including showing you relevant advertisements on other websites and platforms
• To process and evaluate employment applications
• To detect, prevent and address fraud, abuse, security incidents and technical issues
• To comply with applicable laws, regulations, licensing requirements, subpoenas and lawful requests, and to establish, exercise or defend legal claims

We do not use the information you submit through our website to make automated decisions that produce legal or similarly significant effects about you.

5. How We Share Your Information

We do not sell your personal information for money. We share personal information only in the following circumstances:

• Within Regency Palms Senior Living. Your inquiry is shared with the corporate office and with the sales, marketing and leadership team at the community or communities relevant to your inquiry.
• Service providers. We use vendors who perform services on our behalf and are contractually limited to using the information for those services, including website hosting and maintenance, form and email delivery, customer relationship management and lead tracking systems, call tracking and call recording providers, marketing agencies, analytics providers, and IT and security support.
• Advertising and analytics partners. We work with platforms including Google, Microsoft Advertising and Meta. Through cookies and similar technologies, these partners receive online identifiers and activity data, and may use that data to measure campaign performance and to deliver advertising to you across other sites and apps. Under some state privacy laws, this type of disclosure for cross-context behavioural advertising is treated as "sharing" or as a "sale." You may opt out as described in Sections 6 and 10.
• Care and clinical partners. With your consent or at your direction, we may share information with on-site home health, hospice, therapy or physician partners, or with a referring hospital, discharge planner or placement agency, in order to coordinate a move-in or a level of care assessment.
• Professional advisors. Attorneys, accountants, auditors and insurers, under duties of confidentiality.
• Legal and safety. Where we believe in good faith that disclosure is required by law, regulation, legal process or governmental request, including requests from the California Department of Social Services, or is necessary to protect the rights, property or safety of any person, including responding to a resident emergency.
• Business transfers. In connection with a merger, acquisition, financing, reorganisation, sale of assets, or the addition or transfer of a community, personal information may be transferred as a business asset, subject to this Policy.

6. Cookies and Tracking Technologies

Cookies are small text files placed on your device by a website. We and our partners also use pixels, tags, web beacons, software development kits, local storage and similar technologies. We use the following categories:

• Strictly necessary. Required for the site to function, to load pages securely, to submit forms, and to prevent spam and abuse. These cannot be switched off through our site.
• Performance and analytics. Help us understand how visitors find and use the site, which pages are viewed and where visitors drop off, so that we can improve it. These include Google Analytics.
• Functional. Remember choices such as your preferred community or previously entered form details, so you do not have to re-enter them.
• Advertising and targeting. Used to measure the results of our advertising and to show you relevant advertisements on other websites and social platforms. These include the Google Ads conversion and remarketing tags, the Microsoft Advertising UET tag, and the Meta pixel.

Your choices. You can control cookies in several ways:

• Use your browser settings to block or delete cookies. Blocking strictly necessary cookies may prevent parts of the site from working.
• Use our cookie banner or preference control, where displayed, to accept or reject non-essential categories.
• Opt out of Google Analytics using the Google Analytics Opt-out Browser Add-on, and manage Google advertising personalisation in your Google account ad settings.
• Manage Microsoft Advertising personalisation through the Microsoft privacy dashboard and the Microsoft advertising opt-out page.
• Manage Meta advertising preferences in your Facebook or Instagram account settings.
• Use the industry opt-out tools operated by the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org.
• Enable a Global Privacy Control signal in a supporting browser or extension. We treat a Global Privacy Control signal received from your browser as a valid request to opt out of the sale and sharing of personal information for that browser and device.

7. Interest-Based Advertising

We advertise on search engines, social media and display networks, including Google Ads, Microsoft Advertising and Meta. If you visit our website, you may later see our advertisements on other websites and platforms. This is known as remarketing or interest-based advertising. The advertising platforms use cookies and identifiers to recognise your browser or device. We do not provide these platforms with the contents of your inquiry, your care needs, or any health information for advertising purposes. You can opt out using the controls described in Section 6.

8. Communications by Telephone, Email and Text Message

By submitting your telephone number through a form on our website, or by providing it during a call, you agree that Regency Palms Senior Living and the community you inquired about may contact you at that number by telephone call, voicemail, email and, where you have opted in, SMS or text message, regarding your inquiry, tours, availability, pricing and related community information. Calls may be placed manually or by using automated technology.

Consent to receive marketing calls or texts is not a condition of any tour, service, residency or purchase. Message and data rates may apply. Message frequency varies. You may reply STOP to any text message to opt out, or HELP for assistance. You may unsubscribe from marketing emails at any time using the unsubscribe link in the email or by contacting us. We may continue to send you transactional or service messages relating to a tour or inquiry you have requested.

Calls to and from our communities may be monitored or recorded for quality assurance, training and record-keeping purposes. Where recording occurs, you will be notified at the start of the call and may ask that recording be stopped, or may continue the conversation by email.

9. Health Information and HIPAA

Our website is an informational and marketing website. It is not a patient portal, a medical record system, or a HIPAA-regulated platform. Please do not submit detailed medical records, diagnoses, medication lists, insurance identification numbers or other sensitive health information through our website forms or by unencrypted email. Information you submit through the website is treated as an inquiry, not as protected health information.

Once a person becomes a resident of one of our communities, health information created or received in connection with their care is handled in accordance with applicable federal and California health privacy laws and the separate notice of privacy practices and admission documentation provided by that community. Those documents, not this Policy, govern resident health information.

If you voluntarily describe general care needs in an inquiry form or during a call, we use that information only to respond to you and to determine whether our communities can meet those needs. We do not use it for advertising targeting.

10. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act gives you the rights described below.

10.1 Categories of Personal Information

In the preceding twelve months we have collected the following categories of personal information, obtained from the sources described in Section 3, for the purposes described in Section 4, and disclosed to the categories of recipients described in Section 5:

We use sensitive personal information only for the purposes permitted under the CCPA without a right to limit, namely to perform the services you requested and to respond to your inquiry. We do not use or disclose sensitive personal information to infer characteristics about you.

10.2 Your Rights

• Right to know. Request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties to whom we disclosed it.
• Right to delete. Request deletion of personal information we collected from you, subject to legal exceptions such as records we are required to keep under licensing, employment, tax or care regulations.
• Right to correct. Request correction of inaccurate personal information.
• Right to opt out of sale or sharing. Direct us to stop disclosing your personal information to advertising partners for cross-context behavioural advertising. You may exercise this right by contacting us using the details in Section 17, by using the "Do Not Sell or Share My Personal Information" link where displayed on our website, or by enabling a Global Privacy Control signal in your browser.
• Right to limit use of sensitive personal information. As described above, we do not use sensitive personal information for purposes that trigger this right.
• Right to non-discrimination. We will not deny you services, charge you a different price, or provide a different level of service because you exercised a privacy right.

10.3 How to Submit a Request

Submit a request using the contact details in Section 17. We will ask for information sufficient to verify that you are the person about whom we collected personal information, which usually means matching two or more data points such as the name, email address and telephone number you previously gave us. We do not use verification information for any other purpose.

An authorised agent may submit a request on your behalf with written permission signed by you, and we may ask you to confirm the authority of that agent directly. A parent or legal guardian may submit a request for a minor. A person holding a valid power of attorney or conservatorship may submit a request on behalf of a prospective or current resident, with supporting documentation.

We will acknowledge a request within ten business days and respond within forty-five calendar days, with one extension of up to an additional forty-five days where reasonably necessary, in which case we will inform you of the extension and the reason for it.

10.4 Shine the Light

California Civil Code Section 1798.83 permits California residents to request information about disclosures of personal information to third parties for the direct marketing purposes of those third parties. We do not disclose personal information to third parties for their own direct marketing purposes.

11. Privacy Rights in Other States

If you reside in a state with a comprehensive consumer privacy law, including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware and other states as those laws take effect, you may have rights to confirm whether we process your personal data, to access, correct, delete or obtain a portable copy of it, and to opt out of targeted advertising, sale of personal data and certain profiling. You may also have the right to appeal a decision we make on your request. To exercise these rights, or to appeal, contact us using the details in Section 17 and tell us which state you reside in. We honour these rights in accordance with the applicable state law, and we apply the practices described in this Policy to residents of any state whose privacy law takes effect after the date of this Policy.

12. Data Retention

We keep personal information only for as long as necessary for the purposes described in this Policy. In general:

• Website inquiry and lead records are retained while the inquiry is active and for a reasonable period afterwards for follow-up and record-keeping, typically not more than thirty-six months from the last contact, unless a longer period is required.
• Marketing contact records are retained until you unsubscribe or ask to be removed, plus the period required to maintain a suppression list so that we do not contact you again.
• Call recordings are retained for a limited period for quality and training purposes, then deleted in the ordinary course.
• Records that we are required to keep by law, regulation or licensing requirements, or for the establishment or defence of legal claims, are retained for the period required.
• Website analytics and advertising data are retained according to the retention settings of the relevant platform.

13. Data Security

We maintain reasonable administrative, technical and physical safeguards designed to protect personal information against unauthorised access, disclosure, alteration and destruction. These include encryption of our website in transit using HTTPS, access controls that limit personal information to staff with a business need, vendor due diligence and contractual protections, and staff training. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive information to us by unencrypted email.

14. Children's Privacy

Our website is directed to adults. It is not directed to children, and we do not knowingly collect personal information from anyone under the age of sixteen, and in no case from a child under thirteen. We do not sell or share the personal information of consumers we know to be under sixteen. If you believe a child has provided us with personal information, contact us using the details in Section 17 and we will delete it.

Our website may link to third-party websites, including referral directories, social media pages, mapping services, review sites and partner healthcare providers. We do not control and are not responsible for the privacy practices or the content of those third parties. We encourage you to read the privacy policy of every website you visit.
